Washington (AP) After e-cigarette usage among children increased, the Supreme Court will consider federal regulators’ rulings prohibiting sugary vaping goods in a dispute involving vaping that will be heard on Monday.
The Food and Drug Administration has rejected over a million applications to sell kid-friendly candy or fruit-flavored items, and the high court is considering an appeal from the agency.
These rulings are a part of a crackdown that, according to anti-tobacco activists, helped bring teenage vaping down to a 10-year low following an epidemic-level peak in 2019.
However, vaping businesses retaliated in court, claiming that the commission had unfairly ignored their claims that their sugary e-liquids would help adults stop smoking traditional cigarettes but weren’t particularly appealing to children.
The lawsuit comes just before President-elect Donald Trump takes office. Trump promised to stop vaping in a September social media post, which may lead to a different approach from his incoming government.
Lawsuits from vaping companies were dismissed by a number of lower courts, but Triton Distribution, a Dallas-based business, prevailed in the 5th Circuit Court of Appeals. The court overturned a ruling that prohibited the sale of nicotine-containing liquids, such as Jimmy the Juice Man in Peachy Strawberry, that are heated by e-cigarettes to produce an aerosol that can be inhaled.
Even years after the crackdown, flavored vapes that are technically banned but are nonetheless publicly accessible are still available because the FDA was sluggish to regulate the now multibillion-dollar vaping industry.
The agency recently permitted its first menthol-flavored electronic cigarettes for adult smokers and has approved a few vapes with tobacco flavors.
Youth nicotine use has decreased to its lowest level in ten years because to the ban on sugary vapes and more enforcement, according to the Campaign for Tobacco-Free Kids.
