The NAACP ends its challenge over Mississippi creating a new court in majority-Black capital city

JACKSON, Miss. (AP) — The NAACP is settling a lawsuit that contested the Mississippi Legislature’s decision to establish a new state court in Jackson, the state capital, which is ruled by Democrats and has a majority Black population. The legislature is majority white and Republican.

In 2023, the state was sued by the civil rights organization and locals to try to stop the establishment of a court in the Capitol Complex Improvement District, which covers downtown Jackson as well as other areas containing state government offices and upscale shopping centers. The Legislature’s decision to increase the state-run Capitol Police’s patrol area aligned with the court’s creation plan.

Attorneys for the NAACP said in federal court documents filed Monday that the plaintiffs have chosen to dismiss their challenge to the process of appointing officials to serve that court, citing their encouragement at indications that the CCID Court will be constituted with suitable safeguards for Jackson residents.

On Thursday, U.S. District Judge Henry T. Wingate granted the NAACP’s motion and threw out the case.

Since the judge and prosecutors would not be chosen by Jackson residents or local elected officials, the NAACP first claimed that the new court would threaten democracy. According to state legislation, prosecutors will be chosen by the state attorney general, and judges will be chosen by the chief justice of the state Supreme Court. Both the present attorney general and chief justice are conservative white.

The new court was established by lawmakers and Republican Governor Tate Reeves, who believe it is a part of an effort to reduce violence in Jackson. In the last four years, the city, which has a population of roughly 150,000, has seen at least 100 homicides.

Late last year, Wingate declared that he would permit officials to proceed with the court’s creation. Due in part to the state’s original lack of enough room for the court to assemble, the start-up has been delayed.

Municipal courts, which deal with traffic infractions, misdemeanor cases, and initial appearances for some criminal accusations, will have the same authority as the Capitol Complex Improvement District Court. Most municipal court convictions result in jail term for the offender. In a state jail, those found guilty in the new court will be housed next to those found guilty of more serious felonies.

City leaders appoint the majority of municipal judges. Jackson’s city council is predominately Black, and the mayor is Black.
