THE ELECTION IS OVER; CAMPAIGN SIGNS MUST DOWN 


The supervisor of elections for Monroe County, Joyce Griffin, is advising all candidates to remove their campaign signs now that the election is done. Griffin urged fans to assist their candidates in locating and taking down their signs, saying, “I know this can be more difficult than it sounds because candidates often have friends, relatives, and supporters hang signs for them in unknown places.”

The law requires the removal of campaign signs:

106.1435 Political campaign ads: their use and elimination.

(1) Every candidate, whether running for a district, county, state, or federal office, must try in good faith to take down all of their political campaign ads within 30 days of:

(a) Retraction of their candidacy;

(a) Being disqualified as a contender; or

(c) Winning an election.

However, as stated in chapter 479, a candidate is not required to take down political campaign signs that are employed by an outdoor advertising company. Political campaign messages intended to be worn by individuals or ads displayed on automobiles are exempt from the restrictions hereof.

(2) The political subdivision or governmental body has the power to delete political campaign ads and may impose the full cost of removal on the candidate if the ads are not taken down within the allotted time. The money raised to remove these ads will be transferred into the political subdivision’s general revenue.

Political campaign ads are prohibited from being erected, posted, painted, tacked, nailed, or otherwise exhibited, put, or located on or above any state or county road right-of-way in accordance with chapter 479.

(4) A candidate must be informed in writing of the provisions in this section by the official who determines the applicant’s eligibility for office.

(5) This clause does not prohibit local governments from enforcing stricter or more extensive regulations regarding the use and removal of political campaign ads.
