According to court documents, Tate knowingly and purposefully shot a.40 caliber handgun at Huesca, killing him.

Police published security footage of Tate earlier this week.

Huesca had just pulled into his Gage Park house after his shift, still in uniform, when ShotSpotter alerted police to gunshots near West 56th Street and South Kedzie Avenue.

Police suspect the 6-year veteran was slain during a possible carjacking. His vehicle and service weapon were both gone. Investigators discovered his car first and potentially retrieved his gun Friday at a South Side home near 108th and Hale.

According to CBS 2, investigators were present when a relative was seen throwing a handgun over a fence into a yard before being taken into custody.

Tate was scheduled to appear in court in Markham on an unrelated case on Wednesday, but he did not show up.
