On Monday, TikTok requested that a federal appeals court prevent the Biden administration from implementing a legislation that would result in the popular platform being banned until the Supreme Court considers its challenge to the statute.
The lawsuit was filed after a panel of three justices on the same court agreed with the government last week and declared the law to be constitutional. The law forces TikTok to split from its parent business based in China or risk being banned as early as next month.
TikTok and its parent company, ByteDance, which is also a plaintiff in the case, have stated that the well-known app will shut down by January 19, 2025, if the law is not reversed. In the United States, TikTok has over 170 million subscribers.
Attorneys for the two firms argued in the legal filing on Monday that the Supreme Court, as the only court with appellate jurisdiction over this matter, should have a chance to determine whether to examine this extremely significant case before that occurs.
Whether the Supreme Court will hear the case is uncertain.
Donald Trump, who attempted to outlaw TikTok during his previous administration, has stated that he is now opposed to doing so.
The two businesses cited political realities in their court petition, arguing that an injunction would offer a brief reprieve that would allow the incoming administration to decide on its stance, thereby negating the necessity for Supreme Court review as well as the looming harms.
